Reimagining Child Soldiers in International Law and Policy

Reimagining Child
Reimagining Child Soldiers in International Law and Policy
by Mark A. Drumbl
Publication Date: April 15, 2012

Buy new: $35.00
7 used & new from $28.01

(Visit the Hot New Releases in International Law list for authoritative information on this product's current rank.)

Review & Description

The international community's efforts to halt child soldiering have yielded some successes. But this pernicious practice persists. It may shift locally, but it endures globally. Preventative measures therefore remain inadequate. Former child soldiers experience challenges readjusting to civilian life. Reintegration is complex and eventful. The homecoming is only the beginning. Reconciliation within communities afflicted by violence committed by and against child soldiers is incomplete. Shortfalls linger on the restorative front.

The international community strives to eradicate the scourge of child soldiering. Mostly, though, these efforts replay the same narratives and circulate the same assumptions. Current humanitarian discourse sees child soldiers as passive victims, tools of war, vulnerable, psychologically devastated, and not responsible for their violent acts. This perception has come to suffuse international law and policy. Although reflecting much of the lives of child soldiers, this portrayal also omits critical aspects. This book pursues an alternate path by reimagining the child soldier. It approaches child soldiers with a more nuanced and less judgmental mind.

This book takes a second look at these efforts. It aspires to refresh law and policy so as to improve preventative, restorative, and remedial initiatives while also vivifying the dignity of youth. Along the way, Drumbl questions central tenets of contemporary humanitarianism and rethinks elements of international criminal justice. This ground-breaking book is essential reading for anyone committed to truly emboldening the rights of the child. It offers a way to think about child soldiers that would invigorate international law, policy, and best practices. Where does this reimagination lead? Not toward retributive criminal trials, but instead toward restorative forms of justice. Toward forgiveness instead of excuse, thereby facilitating reintegration and promoting social repair within afflicted communities. Toward a better understanding of child soldiering, without which the practice cannot be ended. This book also offers fresh thinking on related issues, ranging from juvenile justice, to humanitarian interventions, to the universality of human rights, to the role of law in responding to mass atrocity.

The Rights of Refugees under International Law

The Rights
The Rights of Refugees under International Law
by James C. Hathaway

Buy new: $105.00 $79.32
37 used & new from $55.60

(Visit the Most Gifted in International Law list for authoritative information on this product's current rank.)

Review & Description

This book presents the first comprehensive analysis of the human rights of refugees as set by the UN Refugee Convention. In an era where States are increasingly challenging the logic of simply assimilating refugees to their own citizens, questions are now being raised about whether refugees should be allowed to enjoy freedom of movement, to work, to access public welfare programs, or to be reunited with family members. Doubts have been expressed about the propriety of exempting refugees from visa and other immigration rules, and whether there is a duty to admit refugees at all. Hathaway links the standards of the UN Refugee Convention to key norms of international human rights law, and applies his analysis to the world's most difficult protection challenges. This is a critical resource for advocates, judges, and policymakers. It will also be a pioneering scholarly work for graduate students of international and human rights law.

Nadav Shragai (Author)

Review & Description

The Holy City of Jerusalem is one of the most contentious facets of the Arab-Israel conflict. In this volume, Nadav Shragai, who served as a journalist and commentator at Ha'aretz between 1983 and 2009 and has documented the dispute over Jerusalem for thirty years, offers a fresh perspective that seeks to correct the international discourse on the future of the city.

There is no true division of Jerusalem into East and West. The division imposed by the Jordanian occupation for a brief period of 19 years is no longer possible in a city which has dramatically grown and changed over the last 44 years.

270,000 Arabs and 200,000 Jews live in the mosaic of neighborhoods called ‘East Jerusalem.’ Arab and Jewish neighborhoods are often intermingled and the spillover of residents is a widespread phenomenon. Jerusalem expert Nadav Shragai offers a fresh perspective that seeks to correct the international discourse on the future of the city.

Nadav Shragai, a senior researcher at the Jerusalem Center for Public Affairs, served as a journalist and commentator at Ha'aretz between 1983 and 2009, He currently writes for Israel Hayom, and has documented the dispute over Jerusalem for thirty years.

Review & Description

A major modern conundrum is how the Arab/Israel conflict remains unresolved and, seemingly, unresolvable. In this inspirational book, Rabbi Michael Lerner suggests that a change in consciousness is crucial. With clarity and honesty, he examines how the mutual demonization and discounting of each sides’ legitimate needs drive the debate, and he points to new ways of thinking that can lead to a solution.

Lerner emphasizes that this new approach to the issue requires giving primacy to love, kindness, and generosity. It calls for challenging the master narratives in both Israel and Palestine as well as the false idea that “homeland security” can be achieved through military, political, economic, or media domination. Lerner makes the case that a lasting peace must prioritize helping people on all sides (including Europe and the U.S.) and that real security is best achieved through an ethos of caring and generosity toward “the other.” As many spiritual leaders have taught, problems like these cannot be solved at the same level at which they originated—one must seek higher ground, and that becomes a central task for anyone who wants a sustainable peace. Embracing Israel/Palestine is written for those looking for positive, practical solutions to this ongoing dilemma.

by John Makdisi

Buy new: $75.00 $58.31

(Visit the Most Gifted in International Law list for authoritative information on this product's current rank.)

Review & Description

Islamic Property Law is the first casebook of its kind to offer Islamic law training to American law students in the comparative case-method style of learning. The several areas of law covered under the umbrella of Property are developed through translations of classical Islamic law texts in conjunction with English and American cases on the same subjects. The materials are sufficiently detailed to provide the type of sophisticated analysis with which law professors and students are familiar.

Although the focus is on Islamic property law, the course also covers areas is torts, contracts, criminal law, wills and trusts, constitutional law, and jurisprudence, insofar as these areas touch on property. In this way the book also satisfies the tradition of comparative law casebooks that are comprehensive in coverage. Readers should gain a sound understanding of property law in classical Islam and an enhanced understanding of property law in the United States.

Global Competition: Law, Markets, and Globalization

Buy new: $40.00 $38.53
12 used & new from $31.21

Review & Description

Global competition now shapes economies and societies in ways unimaginable only a few years ago, and competition (or 'antitrust') law is a key component of the legal framework for global competition. These laws are intended to protect competition from distortion and restraint, and on the national level they reflect the relationships between markets, their participants, and those affected by them. The current legal framework for the global economy is provided, however, by national laws and institutions. This means that those few governments that have sufficient 'power' to apply their laws to conduct outside their own territory provide the norms of global competition. This has long meant that the US (and, more recently, the EU) structure global competition, but China and other countries are increasingly using their economic and political leverage to apply their own competition laws to global markets. The result is increasing uncertainty, costs, and conflicts that burden global economic development.

This book examines competition law on the global level and reveals its often complex and little-understood dynamics. It focuses on the interactions between national and international legal regimes that are central to these dynamics and a key to understanding them.

Part I examines the evolution of the current global system, the factors that have shaped it, how it operates today, and recent efforts to alter that system-e.g., by including competition law in the WTO. Part II focuses on national competition law systems, revealing how national laws and experiences shape global competition law dynamics and how global factors, in turn, shape national laws and experiences. It examines the central roles of US and European law and experience, and it also pays close attention to countries such as China that are playing increasingly important roles in the global competition law arena. Part III analyzes current strategies for improving the legal framework for global competition and identifies the factors that may contribute to a system that more effectively supports global economic and political development. This analysis also suggests a pathway for moving toward that goal.

37 used & new from $23.99

Review & Description

Of all legal subjects, international law is at once the most richly varied and arguably the least understood, even by lawyers. For the past two decades it has been the focus of intense analysis by legal philosophers, international relations specialists, linguists, professional lawyers, historians, economists, and political scientists, as well as those who study, teach, and practice the discipline. Yet, the realities of international trade and communication mean that regulations in one State often directly affect matters within others. In the established tradition of the Clarendon Law Series, International Law is both an introduction to the subject and a critical consideration of its central themes and debates. The book explores the scope and function of international law, and explains how it helps to underpin our international political and economic systems. It then goes on to examine the wider theoretical implications of international law's role in modern society, including issues such as the independence of states, limits of national freedom of choice, human rights, and international crime.

Review & Description

A newsbreaking memoir that tackles head-on the toughest challenge in the world today.

When a dying King Hussein shocked the world by picking his son rather than his brother, the longtime crown prince, to be the next king of Jordan, no one was more surprised than the young head of Special Operations, who discovered his life was in for a major upheaval.

This is the inspirational story of a young prince who went to boarding school in America and military academy in Britain and grew up believing he would be a soldier. Back home, he hunted down terrorists and modernized Jordan's Special Forces. Then, suddenly, he found himself king. Together with his wife, Queen Rania, he transformed what it meant to be a monarch, going undercover to escape the bubble of the court while she became the Muslim world's most passionate advocate of women's rights.

In this exceptionally candid memoir, King Abdullah tackles the single toughest issue he faces head-on- how to solve the Israeli-Palestinian standoff- and reveals himself to be an invaluable intermediary between America and the Arab world. He writes about the impact of the Iraq war on his neighborhood and how best to tackle Iran's nuclear ambitions.

Why would a sitting head of state choose to write about the most explosive issues he faces? King Abdullah does so now because he believes we face a moment of truth: a last chance for peace in the Middle East. The prize is enormous, the cost of failure far greater than we dare imagine.

Regulating Covert Action

Regulating Covert Action
by Professor W. Michael Reisman, Mr. James E. Baker

14 used & new from $25.99

(Visit the Most Gifted in International Law list for authoritative information on this product's current rank.)

Review & Description

Covert activity has always been a significant element of international politics. When it has served their interests, governments have secretly disseminated propaganda in other countries, manipulated foreign economies, and abetted coups against their adversaries. What are the circumstances, if any, in which it is lawful, under international law or United States law, to resort to covert action either directly or through local proxies? When is it right to do so? This book is the first to assess the lawfulness of covert action under United States and international law and to face candidly the implications for democratic states that covert operations pose. Michael Reisman and James E. Baker identify different types of covert actions, discussing a variety of cases that include the Trujillo assassination in 1961, the Rainbow Warrior in 1985, and the raid on Libya in 1986. After explaining the complex operations of the international legal system, they explore trends in decision making and the conditions that accounted for them-whether the covert operations were proactive, defensive, or reactive. They examine in detail the procedures followed in the United States to authorize and oversee covert activity and propose guidelines for political leaders who may contemplate using covert techniques. An appendix reviews twenty years of allegations of covert aggression brought to the attention of the United Nations Security Council.

Review & Description

The international aspects of income taxation have become increasingly important as countries worldwide have become more economically integrated. International Tax Primer provides an introduction to the policies that countries seek to advance with their international tax rules, with numerous examples drawn from the practices of both developed and developing countries. It grew out of the authors' work with the OECD in conducting seminars on international tax for tax officials in countries emerging from the collapse of the Soviet Union.

The book strikes a balance between the specific and the general by illustrating the fundamental principles and structure of international tax with frequent reference to actual practice in a variety of countries. Coverage includes:

  • the role of the tax adviser;
  • tax planning techniques;
  • international double taxation;
  • transfer pricing; anti-avoidance rules;
  • tax treaties, including discussion of the OECD and UN Model Treaties;
  • emerging issues, such as e-commerce and harmful tax competition.

Review & Description

This volume is the first comprehensive commentary on the Convention on the Elimination of All Forms of Discrimination against Women and its Optional Protocol. The Convention is a key international human rights instrument and the only one exclusively addressed to women. It has been described as the United Nations' 'landmark treaty in the struggle for women's rights'. The Commentary describes the application of the Convention through the work of its monitoring body, the Committee on the Elimination of Discrimination against Women. It comprises detailed analyses of the Preamble and each article of the Convention and of the Optional Protocol. It also includes a separate chapter on the cross-cutting substantive issue of violence against women. The sources relied on are the treaty language and the general recommendations, concluding observations and case law under the Optional Protocol, through which the Committee has interpreted and applied the Convention. Each chapter is self-contained but the Commentary is conceived of as an integral whole. The book also includes an Introduction which provides an overview of the Convention and its embedding in the international law of human rights.
